We understand how mentally and physically draining filing for separation and divorce can be. The solicitors at Sydney Legal Practice endeavour to make the process as smooth and minimise the impacts to both yourself and your children (if any) during this emotionally draining process.
Our firm is flexible to your needs. We offer an online service to initiate the process for filing for a divorce. If you want to do it in the privacy of your own home, this is the perfect medium for you, allowing you to complete the application form at your own pace. We understand the complex emotions involved which may take time to resolve, therefore allowing you the private forum to complete this is our intention.
How does Online Divorce work?
Our form for Online Divorce Application is easy and straightforward.
Step 1 – Complete for divorce application form and click the submit button.
Step 2 – Our qualified and skilled solicitor will prepare a draft copy of the Divorce application per your instructions.
Step 3 – The draft is forwarded to you for your approval. Once approved and if accepted, you sign the documents and return it to us. Other requirements include arranging the Application to be signed in the presence of a Justice of the Peace or Solicitor. This includes Certified Marriage of Certificate, Citizenship papers (if applicable) and Certified copy of Passport (if applicable).
Step 4 – We file the Divorce Application on your behalf at the Family Court.
Step 5 – Once returned, we send a sealed copy of the Divorce Application form to your spouse (1 attempt on 1 address only included in our fixed price).
Step 6 – We file an Affidavit of service with the court on your behalf confirming the above.
Step 7 – A proposed hearing date of your application will be advised to you including sealed copies of all relevant documents.
Step 8 – You attend Family Court on your hearing date. One of our barristers or solicitors can represent you at court for a guaranteed flat fee of $550 (inclusive of GST).
However, we offer more than just an online service. If you feel more comfortable speaking to one of our solicitors face-to-face in our offices, we are happy to arrange this.
How much does the Online Divorce Application Cost?
Your guaranteed fixed fee online Divorce Application is $650 , inclusive of GST (nationwide) to prepare, complete, file and serve your documents to the required Courts and respondents. This includes one (1) attempted service fee.
Currently, the cost of a Court Filing Fee is $405. This is payable when the documents in Step 3 (per Online Divorce Application process) is returned back to us.
A request for one of our Solicitors or Barristers to be present during your court hearing will be an additional $550, inclusive of GST.
Any additional costs or requirements will be advised upon request. Under such circumstances, we will clearly communicate the additional costs involved prior to the event happening.
No other hidden extras or hidden disbursements are drawn in.
Requirements to commence Divorce Proceedings:
In order to be commence proceedings to file for Divorce, you must be able to prove the following:
Prove that you have been separated for a period of more than 12 months;
Have lived separately for this 12 month period;
Have been married for more than two years or attended the required counseling with the Family Court. Please speak to one of our Solicitors for more advice if you have been married for less than two years.
At the Date of Filing, at least one spouse must be:
An Australian citizen;
domiciled in Australia; or
resident in Australia for 12 months.
Once proceedings have commenced, it can take four (4) months or longer to obtain a final Divorce Certificate. This will depend on individual circumstances taking into consideration factors such as difficulties in serving your spouse.
If you are wanting to marry straight away, take care. You should not plan to remarry without allowing enough time for the divorce to be finalised which will be one month after the divorce was granted.
